GENERAL TERMS AND CONDITIONS

SCOPE OF APPLICATION

The business relationship between the Gesellschaft der Freunde der Stiftung Haus der Kunst München e.V., Prinzregentenstr. 1, 80538 Munich, Germany, and you as the customer shall be governed exclusively by the following General Terms and Conditions (GTC) in the version valid at the time of the order.

CONCLUSION OF CONTRACT

The offers of the Gesellschaft der Freunde der Stiftung Haus der Kunst München e.V. are always subject to change. By sending your order, you are making a binding offer to conclude a contract. Subsequently, you will receive an order confirmation with invoice as well as our general terms and conditions by e-mail. With this we accept your offer. You can also view the GTC at any time at www.freunde-hausderkunst.de/.

PRICES, PAYMENT, DUE DATE, DELIVERY

The masks from our current offer can be purchased without membership. After successful order you will receive an e-mail with payment instructions (invoice). The amount due is to be paid within 14 days. Payment via credit card or Paypal is not possible. In addition to the sales price, a packaging and shipping fee will be charged based on the ordered number of masks and the destination address. The stated prices include the statutory value added tax. For orders from other European countries, the sales tax identification number (VAT) and an export certificate are required for tax-free delivery. Otherwise we charge the legal value added tax. The masks will be shipped to the specified address within 5 working days after receipt of the order at the latest. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline ends on the next working day. The Gesellschaft der Freunde der Stiftung Haus der Kunst München e.V. assumes no liability for the shipment of the purchased masks.

RESERVATION OF OWNERSHIP

The ordered goods remain the property of the Gesellschaft der Freunde der Stiftung Haus der Kunst München e.V. until full and final payment has been received.

LIABILITY

The Gesellschaft der Freunde der Stiftung Haus der Kunst München e.V. is only liable if it has violated an essential contractual obligation (cardinal obligation) in a way that endangers the purpose of the contract or if the damage is due to gross negligence or intent on the part of the Gesellschaft der Freunde der Stiftung Haus der Kunst München e.V.. If this is not due to gross negligence or intent, the liability of the Gesellschaft der Freunde der Stiftung Haus der Kunst München e.V. is limited to the damage that was reasonably foreseeable at the time of the conclusion of the contract.Liability due to warranted qualities, in the case of personal injury and due to mandatory statutory provisions, in particular the Product Liability Act, remains unaffected.

RIGHT OF REVOCATION FOR CONSUMERS

You may revoke your contractual declaration in writing (e.g. letter, fax, e-mail) within 14 days without stating reasons or – if the goods are delivered to you before the expiry of this period – also by returning the goods. The time limit begins after receipt of this notification in writing, but not before receipt of the goods by the consignee and also does not fulfill our obligations under Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and our obligations under § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. The timely dispatch of the revocation or the goods shall be sufficient to comply with the revocation period. The revocation is to be sent to:

Consequences of revocation

In the event of an effective revocation, the services received by both parties shall be returned and any benefits derived (e.g. interest) shall be surrendered. If you are unable to return or surrender the received performance and benefits (e.g. benefits of use), or are only able to do so in part or in a deteriorated condition, you must compensate us for the loss of value. You only have to compensate us for the deterioration of the item and for any use made of it if the use or deterioration is due to handling of the item that goes beyond the inspection of its properties and functionality. By „testing the properties and functionality“ we mean testing and trying out the respective goods, such as is possible and customary in a retail store. Goods that can be shipped by parcel are to be returned at your own risk. You have to bear the regular costs of the return. Obligations to refund payments must be fulfilled within 30 days. WARRANTY, PROPER HANDLING

It is assumed that all masks, depending on environmental influences, can change their appearance and color and fade. The Gesellschaft der Freunde der Stiftung Haus der Kunst München e.V. does not assume any warranty for this unalterable process of change.

DATA PROTECTION

The Gesellschaft der Freunde der Stiftung Haus der Kunst München e.V. uses the data provided by you for the purpose of fulfilling and processing your order and in accordance with the Privacy Policy of the Gesellschaft der Freunde der Stiftung Haus der Kunst München e.V. Your data will be passed on to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods.

FINAL PROVISIONS

Place of performance and jurisdiction for merchants, legal entities under public law or special funds under public law is Munich. German law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
